Title and land
How do I check a plot for easements and expropriation in Türkiye?
Short answer
Look at the easement, annotation and declaration sections of the land registry record. When an authority decides to expropriate, it notifies the land registry and a declaration is added; easements set up for power or pipelines are also registered.
Details
- Get a copy of the registry record and read the easement, annotation, declaration and mortgage sections.
- If a power transmission line or a gas or oil pipeline crosses or runs near the plot, an easement may exist and building under the line may be restricted.
- An expropriation decision is notified to the registry and a declaration is added; if no valuation and registration case is shown within six months, it is removed.
- Plots reserved for roads, parks or schools in the zoning plan may be expropriated later; check the plan's land-use decision.
- Lines or roads seen on a map are only a preliminary check; the registry record and the authority's letter are decisive.
Example
If the record says "easement in favour of …", building may be restricted along the route. If there is an expropriation declaration, ask the authority about the process before buying.
Legal basis
- Expropriation Law No. 2942, Art. 7 (notification to the land registry and the six-month period).
- Easement provisions of the Turkish Civil Code No. 4721.
