How long do co-owners have to use the right of pre-emption in Türkiye?
Short answer
When a co-owner sells their share to a third party, the other co-owners must use the right of pre-emption within three months of being notified of the sale, and in any case within two years of the sale.
Details
- The sale is notified to the other co-owners through a notary by the buyer or the seller.
- The right is exercised by filing a lawsuit against the buyer.
- The co-owner who exercises it pays the sale price and the title costs the buyer paid.
- No right of pre-emption arises when a co-owner sells to another co-owner.
