What are a tenant's rights in Türkiye?
A tenant can require the property to be handed over as agreed and kept fit for use, major repairs to be done by the landlord, the yearly increase not to exceed the index cap, and eviction only on grounds listed in the law. These rights cannot be narrowed against the tenant by contract.
Details
- The landlord must hand over the property in the agreed condition and keep it fit for use throughout the lease; major repairs are the landlord's.
- For homes and roofed workplaces the yearly increase cannot exceed the twelve-month average change in the Consumer Price Index for the previous rental year.
- A tenant can be evicted only on grounds listed in the law (need, rebuilding, unpaid rent, an eviction undertaking) and usually through court; arbitrary eviction is not allowed.
Example
A landlord cannot evict a tenant just because the term has ended. If the landlord or a close relative genuinely needs the home, eviction can be sought through court within the statutory periods.
Legal basis
- Turkish Code of Obligations No. 6098, Art. 301 (handover and fitness for use).
- Turkish Code of Obligations No. 6098, Art. 315 (notice and period for unpaid rent).
- Turkish Code of Obligations No. 6098, Art. 344 (increase cap).
- Turkish Code of Obligations No. 6098, Art. 347 et seq. (ending the lease and grounds for eviction).
Frequently asked
Can the landlord evict the tenant when the term ends?
No, not for that reason alone. In a residential lease the tenant is deemed to renew unless a legal ground applies; eviction needs a valid ground and usually a court case.
Can I object to a rent increase?
If the increase exceeds the index cap, the excess is void; the tenant can pay the legal amount and dispute the difference or ask the court to set the rent.
