Agency fee
Is a written authorisation agreement with an estate agent mandatory in Türkiye?
Short answer
Yes. A real estate agency must sign a written authorisation agreement with the owner before providing its service; it cannot advertise the property without one.
Details
- The agreement only authorises marketing and brokerage; it is not a sale.
- It states the start and end dates of the authorisation, the property details and the fee.
- For the agent to act at the land registry, a separate power of attorney drawn up by a notary is required.
Legal basis
- Regulation on Real Estate Trade, Article 15
