What are building dues (aidat) in Türkiye and who pays them?
Building dues (aidat) are how owners in an apartment or estate cover shared costs such as the lift, cleaning, caretaker, lighting, water, garden and management. Each unit pays its share; paying is as a rule the owner's debt, but for use-based costs the tenant may also be held responsible.
Details
- Costs such as the caretaker, fuel, garden and general management are as a rule shared equally; some items such as the lift and heating are shared by land share.
- Paying the dues is the unit owner's debt; for costs arising from use, the tenant may be jointly responsible with the owner.
- An owner who does not pay on time can be charged a late penalty of up to five percent per month unless the management plan sets a lower rate.
Example
If monthly dues in an estate are set at 1,500 TL, each flat owner pays this amount. An owner who rents out the flat is responsible for the dues unless the lease provides otherwise.
Legal basis
- Condominium Law No. 634, Art. 20 (contribution to shared costs and late penalty).
- Condominium Law No. 634, Art. 22 (collection of shared-cost debt).
Frequently asked
Does the tenant or the owner pay building dues?
As a rule the owner. A lease can pass use-based costs to the tenant; if the tenant does not pay, the management can turn to the owner.
Are dues payable for an empty flat?
Yes. Caretaker, management and general costs do not depend on whether the flat is used, so the owner of an empty flat pays too.
