How is the land share of a flat determined in Türkiye?
Short answer
In condominium ownership, the land share is set in proportion to the value of the unit. Two flats of the same size can therefore have different land shares.
Details
- Floor, aspect, view and size affect value, so a large flat on an upper floor and a small one on the ground floor have different shares.
- Correction of a land share that was not allocated in proportion to value can be requested from the court.
- In risky buildings the urban renewal decision is taken by an absolute majority of the co-owners weighted by land share. Before the 2023 amendment a two-thirds majority was required.
- Part of the common expenses is also shared by land share.
