How do I check whether a building has an occupancy permit in Türkiye?
Whether a building has an occupancy permit is checked with the zoning or building-control office of the district municipality; the document is issued as the building-use permit. If condominium (kat mulkiyeti) ownership is set up in the title record, the permit has been obtained.
Details
- Ask the district municipality's zoning office using the block and parcel number or the address.
- If the title record shows condominium ownership, the permit exists; if only construction servitude (kat irtifaki) is shown, it may not yet have been obtained.
- Without the permit, permanent utilities and loans can be a problem and condominium ownership cannot be set up, so check before buying.
Example
Before buying a flat you ask the district municipality whether the building has a use permit. If the title shows condominium ownership, the permit is already in place.
Legal basis
- Zoning Law No. 3194, Art. 30-31 (building-use permit required before a building can be used).
Frequently asked
Should I buy a home without an occupancy permit?
It is risky: condominium ownership cannot be set up and some utility and loan steps are a problem. Always check the permit before buying.
Does condominium ownership mean the permit exists?
Yes. Condominium ownership can only be set up after the permit, so a title showing it means the permit was obtained.
