Can a property sale be made at a notary in Türkiye?
Short answer
Yes. Since 1 July 2023 a property sale contract can be made at a notary as well as at the land registry. Ownership passes to the buyer on registration in the land register.
Details
- Before the contract, the notary checks the title record and the owner through the land registry information system.
- After the contract is made, it is notified to the land registry through the system for registration.
- A promise to sell made at a notary is a separate transaction and does not transfer ownership by itself.
- Ordinary written documents signed at an estate agency do not replace a sale contract.
