When is a guarantee on a lease valid in Türkiye?
Short answer
A guarantee must be in writing, and it is not valid unless the guarantor writes the maximum amount of liability and the date of the guarantee in their own hand. A joint and several guarantor must also write that capacity by hand.
Details
- A married guarantor can stand surety only with the spouse's written consent, apart from the exceptions in the law.
- The consent must be given at the latest when the contract is made.
- A guarantee without a maximum amount is invalid.
