Can a tenant sublet in Türkiye?
Short answer
For residential and roofed workplace leases, the tenant cannot sublet the property without the landlord's written consent.
Details
- The main tenant is liable to the landlord if the subtenant uses the property contrary to the lease; the landlord can also turn directly to the subtenant.
- Transferring the whole lease to someone else also requires the landlord's written consent.
- For workplace leases the landlord cannot withhold consent to a transfer without just cause.
- A tenant who transfers a workplace lease remains jointly liable until the end of the lease and for at most two years.
